NEW LABOUR HIRE LICENSING LAWS – CRITICAL DEADLINE – 29 JULY 2026!

The South Australian government introduced the Labour Hire Licensing Act 2017 to protect vulnerable workers from exploitation and ensure fair labour practices across various industries. New labour hire licensing requirements impact all labour hire providers operating in South Australia and reinforce compliance obligations under the Labour Hire Licensing Act 2017. Organisations supplying labour must ensure they understand and meet the updated regulatory requirements to maintain lawful operations and protect their workforce.

Grace Period Deadline

All labour hire providers (except those already licensed before 29 January 2026) have until 29 July 2026 to obtain a valid licence through Consumer and Business Services (CBS); otherwise, trading must cease for those who are required to be registered. Note: This grace period does NOT apply to providers who were already licensed before 29 January 2026 – they must maintain their licence without interruption.

Penalties for Non-Compliance

There are significant penalties if a labour hire provider is operating unlicensed, and entering into avoidance arrangements with an unlicensed provider carries the same range of penalties. The maximum penalty for an individual is $140,000, and for a body corporate (business) is $400,000.

The legislation prescribes the penalties applicable to providers and hosts.
